KALKAN LUXE RENTALS – OWNERS TERMS & CONDITIONS
- Content of Advertisements Kalkan Luxe Rentals accepts advertisements in good faith, expecting advertisers to provide accurate descriptions of their properties. All advertisements must comply with relevant UK legislation, including the Trade Descriptions Act 1968 and the Consumer Protection Act 1987. Advertisers agree to indemnify Kalkan Luxe Rentals against any claims or costs arising from misleading information in their advertisements.
Kalkan Luxe Rentals takes every care to faithfully reproduce the text, prices, contact details, and photographs provided by advertisers. However, we will not be liable for any loss arising from errors or omissions on our part.
Kalkan Luxe Rentals reserves the right to determine the design and layout of advertisements and may, at our discretion, make alterations to submitted text or photographs if deemed necessary. We will not be liable for any loss resulting from such alterations.
- Materials and Photographs Kalkan Luxe Rentals will take the utmost care of all materials and photographs provided for advertisement preparation but cannot be held liable for any loss or damage, however caused.
- Copyright Advertisers must ensure they have the right to reproduce any photographs or digital images supplied to us. Advertisers agree to indemnify Kalkan Luxe Rentals against any claims or costs arising from copyright infringements related to these images.
All digital images produced by Kalkan Luxe Rentals from photographs supplied by advertisers are the property of Kalkan Luxe Rentals and may not be reproduced without our permission.
- Liability Kalkan Luxe Rentals cannot be held liable for any loss or damages incurred at the property, including consequential losses such as lost income, in connection with advertising on the Kalkan Luxe Rentals website.
- Property Rental Licences It is the owner’s responsibility to acquire and display the necessary property rental licence. Kalkan Luxe Rentals will not be held responsible for any holidays cut short or cancelled due to invalid or missing licences. In such cases, the holidaymaker must resolve the matter directly with the property owner.
- Exchanging Properties Each advertisement is assigned to a specific property with a unique reference number. Substituting a different property by altering the text and photographs in an advertisement is not allowed.
- Advertising Properties with Multiple Accommodation Units Properties with two or more accommodation units sharing facilities on a single site may be described in a single advertisement if a “multiple unit property advertisement” with the correct number of units (up to a maximum of four) is purchased. Independent properties cannot be included in a single advertisement, even if they are adjacent.
- Refusal, Termination, or Withdrawal of Advertising Kalkan Luxe Rentals reserves the right to refuse any advertisement submission. If payment has been made, a full refund will be provided, and any materials submitted by post will be returned. Kalkan Luxe Rentals will not be liable for any losses incurred, including lost income or submission costs.
If Kalkan Luxe Rentals receives a complaint about a property, we reserve the right to remove the property from our website without notice if the complaint is reasonably substantiated. Our decision in such matters is final. A pro-rata refund for the remaining unused period of the advertisement may be issued, but no compensation for losses will be provided.
Advertisers may withdraw their advertisement from the Kalkan Luxe Rentals website at any time by notifying us in writing. They may also request reinstatement during the advertising period, but the period will not be extended to account for the time the advertisement was offline.
- Email Enquiry Forms Email enquiry forms on each advertisement are intended solely for genuine availability and booking enquiries. Kalkan Luxe Rentals monitors the use of these forms and may suppress emails that do not meet these criteria or that constitute unsolicited commercial marketing.
- Level of Service Kalkan Luxe Rentals will endeavour to approve new advertisements and make changes to existing ones as quickly as possible. However, due to varying request volumes, we cannot guarantee response times.
Kalkan Luxe Rentals will strive to keep the website available at all times but cannot guarantee 100% availability due to factors beyond our control.
- Disputes Between Owners and Clients Kalkan Luxe Rentals acts solely as an agent to arrange bookings on behalf of property owners and does not accept responsibility for the accommodation. If a client has a complaint, they must first contact the owner or local representative to resolve the issue. If unresolved, the client should submit their comments in writing to Kalkan Luxe Rentals within seven days of returning from the holiday. We will forward the complaint to the owner and assist in resolving it, but it is ultimately the client’s responsibility to address the issue with the owner.
If a client vacates the property before the end of the rental period without authorization from Kalkan Luxe Rentals, they forfeit any rights to compensation. If a dispute leads to the client moving to another property due to the owner’s fault or the property being uninhabitable, Kalkan Luxe Rentals will retain the commission earned from the original rental, with the owner responsible for any refunds.
Due to data protection regulations, Kalkan Luxe Rentals will not provide the holidaymaker’s personal details to the owner unless requested by the holidaymaker. Only the name and surname will be shared.
